Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Apex.Journal (the “Service”), operated by CAP-BUCKS CAPITAL TRADERS(“we”, “us”, “our”), accessible at apexjournal.in. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age and capable of forming a binding contract to use the Service. By using Apex.Journal you confirm that you meet these requirements and that the information you provide is accurate and complete.

2. Your account

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately at hello@apexjournal.in if you suspect unauthorised access. We are not liable for any loss arising from your failure to keep your credentials secure.

3. The Service

Apex.Journal is a trading journal and analytics tool. It lets you import trades (via supported broker APIs such as Zerodha, or via CSV upload), record journal entries, view performance analytics, and receive AI-generated coaching reports. The Service is a record-keeping and educational tool only.

4. Not investment advice

Apex.Journal does not provide investment, trading, tax, or financial advice, and is not a registered investment adviser or research analyst. All analytics, patterns, and AI-generated content are for informational and educational purposes only and must not be relied upon as a recommendation to buy, sell, or hold any security. Trading in securities and derivatives carries substantial risk of loss. See our Disclaimer for details.

5. Subscriptions and billing

Apex.Journal offers Free, Pro (₹999/month) and Elite (₹2,499/month) plans. Paid subscriptions are billed in advance through our payment processor, Razorpay. By subscribing, you authorise us to charge the applicable fees to your chosen payment method. Plans renew automatically each billing period unless cancelled. You can cancel at any time from your account settings; cancellation stops future renewals but does not retroactively refund the current period except as described in our Refund Policy.

6. Acceptable use

You agree not to: (a) reverse-engineer, scrape, or attempt to gain unauthorised access to the Service; (b) use the Service to violate any law or third-party right; (c) resell or sublicense the Service without our written permission; or (d) upload malicious code or interfere with the Service’s operation.

7. Intellectual property

The Service, including its software, design, and branding, is owned by CAP-BUCKS CAPITAL TRADERS and protected by applicable intellectual property laws. Your trade data and journal entries remain yours; you grant us a limited licence to process them solely to provide the Service (including generating AI coaching).

8. Third-party services

The Service relies on third parties including Supabase (data storage), Razorpay (payments), Zerodha Kite Connect (broker sync), Anthropic (Claude AI, for coaching reports) and Resend (email). Your use of the Service may be subject to those providers’ terms. We are not responsible for third-party outages or actions.

9. Disclaimers and limitation of liability

The Service is provided “as is” without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that analytics or imported data will be accurate or complete. To the maximum extent permitted by law, our total liability for any claim arising from the Service is limited to the amount you paid us in the three (3) months preceding the claim. We are not liable for trading losses, lost profits, or indirect or consequential damages.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to us or others.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in India.
